North Warwickshire Leisure - General Terms and Conditions
The Leisure Facilities
The facilties are owned by and operated on behalf of North Warwickshire Borough Council.
Facility use
Facility use is subject to the rules, regulations and local bylaws in force.
The Council reserves the right to deny use of its Leisure Facilities where customers do not comply with the above.
Limitation of Liability
Customers must agree that neither the Council nor its employees shall be liable for any loss, damage or theft of any property belonging to, or brought onto the premises by a customer, occuring within the centre unless caused by negligence of the management, employees or agents of the Council.
Payment by Direct Debit
Direct debit payments are made monthly in advance. These payments may be increased, subject to 30 days notice at the discretion of the Council. Direct Debit payments are non-refundable and non-transferable. Customers may not permit others to use North Warwickshire Leisure Facilties on their behalf. (See exclusions).
After the initial 12 payments the contract will automatically continue at the stated price, unless you instruct us otherwise. After the initial contract period customers may cancel by giving one calendar month’s written notice.

Fitness suite and classes at all facilities, swimming and Studio at Atherstone, anytime*.
Lifetimes Polesworth
Fitness suite and classes at Polesworth, anytime*.
Lifetimes Coleshill
Fitness suite and classes at Coleshill, anytime*.

NB: An induction may be required at each facility but will incur no extra charge.
Direct Debit Cancellation
Non-contract customers may cancel their arrangement by giving one calendar month’s notice. This is to cover the Direct Debit set up and removal costs.
Contract customers who wish to cancel within their initial 12 payments are required to pay the remaining contract amount in full. A further administration fee will be payable should this cancellation procedure not be adhered to. All cancellation requests should be made by completing the Online cancellations form available on our website. Once submitted you will receive an email acknowledgement of your request.
Bookings and Cancellations
Members can book activities up to seven days in advance. Failure to give 24 hours notice of cancellation may result in a cancellation fee being charged to the cardholder. We make every effort to re-let bookings and where this is the case there is no charge. Non members can book activities up to three days in advance, payment is required at the time of booking and is non refundable.
The management reserves the right to refuse to re-book customers who continually fail to honour bookings.

Customers must not abuse the equipment or facilities of the centre. Any damage to Council property shall be paid for in full by any customer who wilfully or negligently causes such damage. Disorderly, rude or offensive behaviour will result in a customer being refused entry to Council facilities.
No customer shall bring alcohol into the building. Customers may not use the facilities whilst under the influence of alcohol, drugs or other mood altering substances. Customers use the facilities at their own risk and the Council does not accept responsibiltiy for any harm or injury to any customer unless caused by the management, employees or agents of the Council.

Cars parked in leisure centre car parks are left at the owners risk and the Council will accept no liability for loss or damage thereof, unless caused by the negligence of the management, employees or other agents of the Council.
Dress
Appropriate clean clothing and shoes must be worn at all times within the facilities. Suitable clothing includes, jogging bottoms, leggings, shorts, singlet / t shirt and trainers.
Physical condition
The customer warrants and represents that he/she is in good physical health and knows of no medical or other reason why he/she is not capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition. The customer shall not use any North Warwickshire Leisure Centres whilst suffering from any infectious or contagious illness, disease or whilst suffering from any other ailment such as open cuts, or where there is a risk that use of the facilities may be detrimental to the health, safety or comfort of other customers.
Children
Children under 16yrs of age may use facilities subject to the rules and regulations of the individual sites.
Other
The normal hours of operation and the hours which any facility is open and available for use are obtainable upon request or via the the Councils website. The Council reserves the right to adjust the hours of opening for the purposes of cleaning, maintenance, decoration, repair, elections or for public holidays. The Council will endeavour to give reasonable notice of any alteration to normal opening hours. The failure of the Council to enforce any of their respective rights at any time and for any period shall not be construed as a waiver of such rights.
