Gambling Act 2005
The Gambling Act 2005 created a new system of licensing and regulation for gambling and lotteries with existing controlling legislation being repealed.
The major functions of licensing authorities under the Act are to;
- license premises for gambling activities
- grant permits for gaming and gaming machines in clubs and miners' welfare institutes
- regulate gaming and gaming machines in alcohol licensed premises
- grant permits to family entertainment centres for the use of certain lower stake gaming machines
- grant permits for prize gaming
- register small societies' lotteries
The council's Statement of Licensing Policy setting out the principles which it will apply in exercising its functions under the Act.
Review of Statement and licensing policy - Under the provisions of the Gambling Act, the Council is required to draft, consult on and publish a Licensing Policy - Statement of Principles which sets out the policies and principles that the Council will apply when carrying out its licensing functions under the Act. Licences and permits for amusements with prizes machines.
The council is responsible for issuing permits for amusements with prizes machines (one armed bandits) in premises in the borough. This includes public houses and clubs.
In relation to public houses, there is an automatic entitlement to two machines but a notification must be submitted with the appropriate fee to the licensing authority. Further details are available about Gambling Act 2005.
