On 11 and 12 June 2024, the High Court heard NWBC’s application for a final injunction at Kingsbury Oil Terminal. The Court has reserved judgment, adjourned the application part-heard and confirmed that the interim injunction and power of arrest continue in force until Judgment is finally delivered.
The Court also:
- Required NWBC to amend of the “Persons Unknown” defendant so as to define that class of defendant more narrowly by reference to their conduct which is alleged to be unlawful. NWBC has now done this and the redefined persons unknown defendants are clear on the face of the Order, the interim injunction and power of arrest.
- Accepted an undertaking from one named defendant.
- Gave 40 named defendants liberty to apply to the Court for relief from sanctions for the purpose of participating in the hearing of the application for a final injunction and power of arrest which stands adjourned part-heard, should they wish to do so, and/or apply to vary or discharge the interim injunction and power of arrest dated 6 May 2022.
- Made various directions as to service.
